Allcare Distribution Limited – Account Terms & Conditions 

(Effective October 2025) 

These Terms & Conditions apply to all transactions, quotations, and orders placed with Allcare Distribution Limited (“we”, “us”, “our”) by you (“the Customer”). By applying for an account, placing an order, or accepting delivery, you agree to be bound by these Terms & Conditions. 

 

1. Account Application 

To open an account, please complete the online application form on our website. Once approved, you’ll receive an email to create a secure login. Your login provides access to our product range, pricing, order placement, and order history. 

 

2. Pricing 

  • All prices are in New Zealand Dollars (NZD) and include GST
  • Prices may change without prior notice. 
  • The price charged will be the price in effect at the date of order. 

 

3. Goods and Services Tax (GST) 

GST is applied to products as outlined by the New Zealand Inland Revenue Department

 

4. Delivery & Freight 

  • Delivery charges apply to all orders and are shown online during checkout. 
  • Delivery is to ground floor or front door only and does not include unpacking or installation
  • Risk in the goods passes to the Customer upon delivery. 

 

5. Payment Terms 

  • Approved account holders: Payment is due by the 20th of the month following invoice
  • Non-account customers: Payment is required in advance via credit card or other approved method. 
  • We reserve the right to suspend or cancel accounts in arrears. 

 

6. Retention of Title (Ownership) 

  • Ownership of all goods supplied remains with Allcare Distribution Limited until payment is received in full
  • Until title passes: 
  • The Customer holds the goods as bailee and must keep them identifiable and in good condition. 
  • We may, at any time, enter the Customer’s premises (or any premises under their control) to recover goods not paid for. 
  • This clause survives termination and applies notwithstanding delivery or resale. 

 

7. Product Availability 

  • All products are offered subject to availability. 
  • We aim to supply all orders complete; if an item is out of stock, we will advise you and endeavour to supply it as soon as possible. 
  • We may supply an equivalent item. If an item is discontinued and no suitable replacement is available within an acceptable timeframe, we will refund you the cost of the item. 

 

8. Incorrect Delivery, Non-Delivery, Damage or Defect 

  • Please inspect goods upon receipt. 
  • Claims for incorrect delivery, shortages, damage, or defects must be made within 7 working days of receipt. 
  • If an order fails to arrive, please notify us within 14 days of order date
  • Claims outside these timeframes may not be accepted. 

 

9. Returns & Refunds 

  • Goods may not be returned without prior authorisation. 
  • Return authorisation must be requested within 7 days of purchase. 
  • Returned goods must be in resaleable conditionin original packaging, and freight paid by the Customer
  • 15% restocking fee may apply. 
  • Once inspected and approved, refunds will be processed to the original payment method within 30 days
  • We are under no obligation to accept returns outside of these conditions. 

 

10. Product Descriptions 

  • We take care to ensure descriptions, images, and specifications are accurate. 
  • Specifications may change without notice. 
  • If a substitute product is unsuitable, we will provide a full credit or refund. 

 

11. Warranty 

  • All products are supplied with the manufacturer’s warranty
  • Warranty coverage applies only when goods are used in accordance with manufacturer instructions
  • Warranty does not cover damage from improper use, lack of maintenance, misuse, or operation outside of specifications. 

 

12. Privacy Policy 

  • We respect your privacy. 
  • Personal details are securely stored and used only for processing orders, communication, and account management. 
  • We do not sell, swap, or share personal information with third parties. 
  • Our website uses cookies to improve your experience and maintain shopping carts. 
  • We may collect your IP address for order verification and fraud prevention.

13. Payment Security 

  • All online transactions are processed securely using Eway or other approved payment gateways. 
  • Our website is protected by SSL encryption to safeguard your data.

14. Force Majeure 

We shall not be liable for any failure to perform contracts or supply goods due to circumstances beyond our control, including (but not limited to) strikes, fires, explosions, floods, riots, civil unrest, military unrest, lockouts, injunctions, interruptions in manufacturing or transport, accidents, inability to obtain supplies, war, or government actions. 

 

15. General 

  • These Terms are governed by the laws of New Zealand
  • Any variation must be agreed to in writing. 
  • We reserve the right to update these Terms from time to time; the latest version will apply.
